FLEX GYMS LTD MEMBERSHIP RULES. TRADING AS TWYFORD HEALTH CLUB

Gym Membership Contract

This Gym Membership Contract (the "Contract") is entered into between Flex Gyms Ltd (TA Twyford Health Club), located at 21a London RD, Twyford (the "Gym"), and the member (the "Member") who excepts these terms and conditions upon joining the gym. This Contract outlines the terms and conditions governing use of the facilities, the membership, including membership fees and charges, and the payment recovery process.

Please note that some form of satisfactory identification, will be required at the time of being issued your access device for physically using the club’s facilities. For student members, this will include showing a valid student ID, proving that you are in full-time education. For new members wishing to pay by direct debit, we will require confirmation of your bank account details (i.e., cheque guarantee card or cheque book) if you have not already signed up online.

Flex Gyms Ltd reserves the right to reject an application for membership, or refuse admission, without ascribing any reason for doing so.

This document forms a legally binding contract between the member and Flex Gyms Ltd. The Member agrees to abide by these and other Flex Gyms Ltd rules, regulations and guidelines that may be posted on the Gym’s website or notice boards.

At enrolment, members must declare any injury, illness or other health condition that may prevent them from using any of the gym facilities and agree they will only return to exercise after consultation and approval of their doctor. New members must fill in all forms to the best of their knowledge. Any payments made for a membership or service provided by Flex Gyms Ltd using false information will result in any fees paid being forfeited. Members using the online exercise services understand that they do so entirely at their own risk and will not be under the supervision of the class instructor. Gym members are responsible for making sure that the area and equipment being used is safe and fit for purpose if not being carried out using the gym facilities.

The Gym can only be used after attending a health check and induction with a trained member of staff.  If you do not wish to have a gym induction, you declare that you fully understand how to use the equipment you use and will not attempt to use any equipment that you have not safely used before. If after filling out the initial health check form a member develops any sickness, injury or changes to their health that could affect their exercise routine, they must inform a member of staff and be advised on what exercises they should or should not do before continuing to use the facilities. Members undertaking any other exercise class or outdoor activity must inform the instructor prior to commencement of the session of any injury, illness or other health condition that may prevent them from completing some or all of the exercises planned.

At enrolment, Members will be asked to make a pro rata payment for the current month’s subscription. Membership subscriptions are payable either annually at joining or monthly until the following rate review date and then annually on the rate review date each year or monthly by direct debit.

All direct debit draws will take place on or around the 1st of the month. Where the collection date falls on a weekend or a bank holiday the subscriptions will be drawn from the members bank account on the next available working day.

Should you fail to meet your ongoing commitment to pay subscriptions, access to the Flex Gyms Ltd premises will be refused. All memberships obtained or continued with false or out of date information will be immediately cancelled without a refund.

Membership Fees: The Member agrees to pay the membership fees as specified in the Membership Fee Schedule provided by the Gym. Membership fees are payable in accordance to the membership tariff you have subscribed to. The Gym reserves the right to adjust membership fees with advanced notice.

Late Payment Charges: In the event that the Member fails to make a timely payment of the membership fee, the Gym may impose late payment charges, including but not limited to:

Late Payment Fee: A fee of £10 may be charged for payments received after the due date specified in the Membership Fee Schedule.

Membership joining fees, administration charge and subscription fees, fixed by Flex Gyms Ltd, are reviewed annually and may be altered at any time, with immediate effect. Existing members are notified in writing of any changes with a minimum of one weeks’ notice. If a payment request is made from your bank account and is rejected due to insufficient funds or for any other reason, access to the club and all services of Flex Gyms Ltd will be suspended until such a time as our account payments are up to date. You agree to forfeit any time missed between the failed collection of membership monies and when you bring your account payments up to date.

Debt Recovery:

In the event of non-payment of membership fees, the Gym will make reasonable efforts to contact the Member through reminder letters, emails, SMS messages, or other forms of communication to notify them of the outstanding balance.

An attempt to collect outstanding fees and charges will be made no sooner than 5 working days after the initial bounced payment.

If non-payment persists, the Gym may issue a formal demand letter outlining the outstanding debt, any applicable interest and charges, and a specified deadline for payment.

The Gym may engage a debt collection agency or, any other third party company, to assist in recovering the outstanding debt. The Member agrees to bear any fees associated with the services of the debt collection agency and/ or third party company.

Should the debt remain unpaid, the Gym reserves the right to initiate legal action, which may include taking the matter to a small claims court or county court to seek a judgment.

Failure to resolve the outstanding debt may result in the Gym reporting the debt to credit reference agencies, which could impact the Member's credit score.

FLEX GYMS LTD CLUB RULES

In addition to Flex Gyms Ltd membership rules concerning the administration of memberships, member’s attention is drawn to the club rules on the following:

 Opening times

Members may use the gym between 530 am and 10 pm Monday to Friday and 7 am-430 pm on Saturdays and 7 am-2pm Sundays.

Dress code

 It is required that you wear loose comfortable sports clothing when exercising in the gym and when using the equipment. Appropriate footwear must also be worn when exercising. Open toed shoes, flip flops or other inappropriate footwear must not be worn in the gym.

 Smoking policy

There is to be no smoking in the gym or surrounding parking area under the windows. If members wish to smoke, they must do so away from the building.

 Health and fitness rules

The gym is for use by people aged 16 years and older. Before commencing any exercise offered by Flex Gyms Ltd, a pre-exercise questionnaire must be completed. The gym may not be used without filling in this form. If reason is found for the member to refrain from exercising a doctor’s note may be required before permission is granted to use the gym.

Any guest wishing to use the gym must complete a pre-exercise questionnaire.  The guest will then be the sole responsibility of the member when using the gym. It is the responsibility of the member to ensure their guest fully understands how to use any equipment in the gym before allowing them to embark on any exercise. Members are expressly forbidden to give access to the facilities to anyone other than themselves by sharing their access fobs or by any other means.

Unmanned hours.

During unmanned hours you confirm that using the facilities is entirely at your own risk. Panic buttons are in place at various locations around the gym in case of an emergency. These can be activated by pressing and holding the button down until the alarm triggers. Once triggered a member of staff or the emergency services will attend the site as soon as possible. Please familiarize yourself with where they are by referring to the gym notice board. Do not attend the gym during unmanned hours if you have any health concerns or if you are feeling in any way unwell.

Safety and hygiene

Please ensure that you only exercise in clean odour free kit, have clean footwear and a towel with you whenever you use the gym to wipe down any equipment that you use.  Antibacterial sprays and paper towels are also provided for you to clean the kit with.


Mobile phone usage

Mobile phones are not to be used in the gym area unless in the case of an emergency. They may be used in the reception, top of the stairs or parking area.

Fire exits and procedures.

In the event of a fire please leave the building via your nearest exit immediately. The two exits are located at either end of the Gym. The first goes into the reception area and out onto the high street. The second goes into the car park. Please assemble on the main road at the front of the property

Gym membership termination

Gym membership may be terminated by giving no less than 1 weeks’ notice in writing to the gym after the contracted term of your membership plan. Flex Gyms Ltd reserves the right to refuse admission and/or expel any member with immediate effect, if any member shall, in the opinion of the Gym, cause nuisance, annoyance, breach any rules, or for any other reason which the Gym may deem appropriate. This includes ending the members access to online exercise classes without prior notice. In the event of any dispute the senior member of staff’s decision will be final.

Use of the facilities

Flex Gyms Ltd may at any time, without penalty, withdraw all or part of its facilities or exercise activities/classes for any period or periods with or without notice in connection with any cleaning, repair, alteration or maintenance work or for any other reason that the senior member of the Gym staff deems necessary. Flex Gyms Ltd also reserves the right to set aside facilities for social or sporting events and details will be published to the Gym members on the Gym notice board or by another means.

Parking

You are entitled to park in the carpark directly next to Twyford Health Club, shared with Tesco Express, for up to 2 hours, provided you enter your vehicles registration into the tablet next to reception every time you park to use the clubs’ facilities. Flex gyms ltd do not accept liability for any parking charges issued to people using the carpark. It is understood that if you use the car park, you are solely responsible for entering the correct information into the tablet on the gym reception.

Data protection

We will use your personal information to provide you with the services, products, or information that you have requested and for administration purposes. We may need to share your information with our service providers, associated organisations, and agents for these purposes.  We will not share your information with any external party for marketing or promotional purposes. We take appropriate measures to ensure that the information disclosed to us is kept secure, accurate and up to date and kept only for so long as is necessary for the purposes for which it is used. We may also need to disclose your information if required to do so by law. By providing us with your personal data, including sensitive personal data such as on your health, you consent to the collection and use of any information you provide in accordance with the above purposes and this privacy statement. You have the right to ask for a copy of the information we hold about you and to have any inaccuracies in your information corrected. You agree that we may use photographs of yourself for promotional purposes unless you expressly forbid us to do so. If you do not wish to be seen in any online exercise classes, please inform the class instructor before the commencement of the class.

If your personal details change, please help us to keep your information up to date by updating a member of staff or by notifying us at flexgymsltd@gmail.com. Debit, Credit and Bank account changes can be changed by calling the gym on 01183271250.

We reserve the right to amend this privacy statement.

 Liability

All members and their guests use the gym and online facilities at their own risk and understand that Flex Gyms Ltd will accept no responsibility for any illness or injury howsoever caused.

 Flex Gyms Ltd liability for damage to member’s property is strictly limited to any damage or loss suffered because of negligence of its staff. With this exception Flex Gyms Ltd will not accept liability for money, valuables or other personal property of members and guests. Any property stored or left at the Gym is done so at the owner’s own risk and no liability for loss or damage will be accepted by Flex Gyms Ltd.

 Vehicles, motorcycles, mopeds and bikes parked or left in Flex Gyms Ltd car park or elsewhere on the premises of Flex Gyms Ltd and all contents in or on them, are left at the owner’s own risk. Flex Gyms Ltd will accept no responsibility for loss or damage in respect thereof.

Flex Gyms Ltd cannot accept any liability for any accident to any member or guest that may occur on the premises or within the grounds of the gym or when using our online services and recordings. Any member or guest that suffers an accident on Flex Gyms Ltd premises, or within its grounds, must report the accident and the circumstances under which it occurred, to the manager of the Gym immediately following the incident.

General

Flex Gyms Ltd reserves the right to amend these rules, and all tariff charges, at any time and without notice to members. Notification of any changes will be passed on to members. This document states that you are agreeing to be bound by the rules of Flex Gyms Ltd and accept that when exercising in the gym or when using our online services, there may not be any staff present and that there is an increased risk of injury or death if you undertake exercise.  You also understand that any exercise undertaken, and equipment used within this facility or online is voluntary and at your own risk and agree to waive all legal recourse, for damages to yourself or others arising from your participation. You also agree to abide by the direction and advice of the staff, whether verbal or in writing, and to conform to the standards of acceptable conduct whilst in the facility or participating online. It is your responsibility to be aware of any changes that are made to the rules governing Flex Gyms Ltd.

Assumption of liability:

It is understood that subject to the rules and regulations of Flex Gyms Ltd, and those as may be from time to time enforced, Flex Gyms Ltd shall determine the membership subscriptions which will be charged to all members of the Gym. Membership of the Gym does not confer upon me in any way ownership of Flex Gyms Ltd property, assets, or premises. I agree that I am personally liable for the payment of the applicable membership subscription and charges incurred by me and my guests that use the amenities of the Gym and/or its services.

 Please note: the option to pay membership subscriptions by monthly direct debit, credit or debit card, is a contractual agreement.

If accepted for membership I (and any guest introduced by me), will observe the rules relating to the Gym and membership, a copy of which I have read or had the opportunity to read. By ticking the box, I hereby confirm that I have read and accept Flex Gyms Ltd terms and conditions.
